Website Terms of Use
Rules for using this website, its content and digital features. Property-service contracts remain separate.
Homesfirst LLC operates myhomesfirst.com (the “Site”). Contact: joe@myhomesfirst.com; (717) 200-9311; 502 W 7th St, Ste 100, Erie, PA 16502, US.
1. Scope and agreement
These Terms address access to the Site, its content, inquiry features and any Homesfirst-controlled digital account features. Read them before using those features. Where we present an acceptance control, you should accept only after an opportunity to read and retain these Terms. Agreement and enforceability remain subject to applicable requirements for notice, assent and consumer protection.
These are website-use rules, not a Residential, Portfolio or Commercial service contract. A visit, inquiry or portal login does not by itself enroll you in a plan, authorize work, accept a quote or create a paid service agreement. Property services, pricing, payment, refunds, cancellation and service warranties are governed by the separately accepted agreement and applicable law. These Terms do not amend an existing service agreement.
The Privacy Policy separately describes personal-information handling. Reading or accepting these Terms is not consent to marketing, unnecessary cookies or processing that legally requires a separate choice.
2. Eligibility and authority
Use account and inquiry features only if you are at least 18 or otherwise legally authorized to enter the relevant transaction. If you act for a business or property owner, you must have authority to submit the information and make the requests involved. Do not impersonate another person or claim authority you do not have. General information on the Site does not establish service eligibility or availability.
3. Intellectual property and permitted use
The Site’s branding, logo, text, layout, graphics, photographs and other content are owned by Homesfirst or its licensors and are protected by applicable intellectual-property laws. Third-party names and materials remain the property of their owners. No ownership is transferred to you.
Subject to these Terms and applicable law, you may view the Site and retain reasonable copies for personal use or internal business evaluation of Homesfirst services. Keep copyright and trademark notices intact. You may not reproduce or commercially distribute substantial Site content, sell it, falsely present it as your own, use Homesfirst branding to imply endorsement, or create a competing collection from it without permission. This does not restrict fair use, other statutory exceptions or rights you already hold. Send permission requests or specific infringement concerns to joe@myhomesfirst.com; this contact is not a representation of a registered DMCA agent.
4. Information and materials you submit
Provide information that is accurate to the best of your knowledge and that you are entitled to share. Do not put payment-card details, passwords, access codes, government identifiers, medical information or other unnecessary sensitive information in a general inquiry.
You retain ownership of your submissions. You give Homesfirst a limited, nonexclusive permission to use and transmit them to relevant service providers only as reasonably needed to receive, review and respond to the submission, provide requested features, and maintain lawful records, subject to the Privacy Policy and applicable law. This is not a transfer of copyright in your reviews and is not permission to use private messages, property photographs or testimonials in advertising without any separately required authorization.
5. Acceptable conduct
Do not use the Site to break the law, infringe another person’s rights, impersonate someone, commit fraud, send threats or unlawful harassment, distribute malware or spam, obtain unauthorized account access, exploit vulnerabilities, evade access controls, or materially disrupt the Site or its users. Do not use automated extraction that circumvents technical restrictions, imposes an unreasonable load, or infringes protected content. Lawful accessibility tools, ordinary search indexing and conduct protected by law are not prohibited by this clause.
Nothing here prohibits an honest review, a lawful complaint, communication with a regulator or law-enforcement agency, or exercise of a protected consumer right. No review penalty, confidentiality obligation covering honest consumer opinions, or transfer of ownership in consumer reviews is imposed.
6. Account access and account control
Where a digital account or portal is offered, use only your own authorized access. Protect your email account, credentials and sign-in links; do not share access with an unauthorized person. Tell Homesfirst promptly if you suspect misuse of Homesfirst-related access. Do not rely on a general contact form for an urgent security response.
Within its actual administrative authority, Homesfirst may restrict its own website/account features or request a provider restriction when reasonably necessary for security, unlawful conduct, material misuse, legal obligations or maintenance. Where lawful and practical, we will explain the restriction and provide a contact route to seek review. Third-party providers control their own platforms under their own terms; these Terms do not grant Homesfirst powers it does not have over those systems.
A digital-access restriction does not itself cancel a paid service agreement, erase lawful payment/refund obligations or eliminate rights to notices, records or remedies. Contact joe@myhomesfirst.com to discuss alternative access to information you are entitled to receive. Account closure and personal-information deletion are distinct matters, subject to applicable law and lawful recordkeeping.
7. Site information, requests and third-party features
Content is general information and may change. Availability, property suitability, final scope, scheduling and complete prices must be confirmed through the applicable quote or service agreement. We may correct errors, but no correction retroactively alters a binding transaction without a lawful basis. Nothing permits misleading advertising or overrides an express promise in an accepted agreement.
General maintenance content is not a substitute for an on-site assessment or qualified specialist advice. Do not undertake dangerous work based on website information. For fire, a suspected gas leak, immediate danger or a medical emergency, contact emergency services or the utility first. The Site and inquiry form are not emergency-dispatch services.
Links may take you to Jobber or other third-party sites. Their features, terms and privacy practices apply to their own systems. A link is not an endorsement of all third-party content, and Homesfirst does not guarantee third-party availability. We remain responsible for duties the law places on Homesfirst.
8. Website warranty disclaimer
TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS GENERAL INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT A PROMISE OF UNINTERRUPTED, ERROR-FREE OR MALWARE-FREE ACCESS, OR A WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
This website disclaimer does not disclaim an express service warranty, a duty in an accepted service agreement, accurate advertising obligations or a nonwaivable statutory right. Some laws do not allow particular disclaimers; those disclaimers do not apply where prohibited.
9. Limits on website-related liability
TO THE EXTENT PERMITTED BY LAW, HOMESFIRST AND ITS OFFICERS, EMPLOYEES AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSSES, INCLUDING LOST PROFITS, ARISING FROM USE OF OR INABILITY TO USE THE SITE OR GENERAL WEBSITE INFORMATION, WHETHER A CLAIM IS FRAMED IN CONTRACT, TORT OR OTHERWISE.
This exclusion is limited to website/digital-feature use. It is not a release for injury or property damage arising from property-maintenance work, and it does not change a separately accepted service agreement. It does not exclude or limit fraud, intentional misconduct, recklessness, gross negligence, liability that cannot lawfully be excluded, or a consumer’s nonwaivable rights or remedies. No universal dollar cap, shortened claim deadline or waiver of all negligence claims is imposed by these Terms.
10. Responsibility for unlawful business misuse
If you use the Site on behalf of a business, and to the extent enforceable under applicable law, that business is responsible for third-party claims and reasonable direct defense costs caused by its intentional unlawful misuse of the Site or knowing infringement through its submissions. This does not shift Homesfirst’s own misconduct, negligence or statutory duties to you.
Any request for reimbursement must identify the claim and its basis, provide reasonably prompt notice and a reasonable opportunity to participate in the defense. No settlement may impose a payment or admission on you without your written agreement. This clause does not penalize an honest review, lawful consumer complaint or good-faith rights request.
11. Governing law and dispute resolution
Pennsylvania law and applicable federal law govern these website Terms, without displacing mandatory protections that apply to you. For website disputes, the forum is a court with subject-matter jurisdiction in Erie County, Pennsylvania, or the federal district serving Erie County, except where applicable law gives a consumer a nonwaivable right to another forum. A claim eligible for small claims court may be brought in an authorized small claims forum.
You may first contact joe@myhomesfirst.com so that we can try to resolve a concern informally. Doing so is encouraged, not a prerequisite that delays a filing deadline, urgent relief, a regulator complaint or a statutory remedy. These Terms impose no mandatory arbitration, class-action waiver or jury-trial waiver. A different dispute provision in a separately accepted service agreement must be considered on its own lawful terms.
12. Changes, severability and no waiver
Changes will be identified by a revised effective date and apply prospectively. Where law requires notice or renewed assent, posting alone is not a substitute. A later version does not silently rewrite an existing service contract or authorize materially different uses of previously collected information.
If a provision cannot lawfully be enforced, it applies only to the lawful extent, or is severed if necessary; the rest remains effective to the extent permitted by law. Failure to enforce one provision on one occasion does not waive it. These Terms cover their website-use subject matter only and do not supersede an applicable service agreement or nonwaivable law.
